We understand that this is a difficult question and often stops people from going to any attorney to develop an Estate Plan. It is not like cars that you can go test drive for free. But wait. Sure, any attorney can draft a Will and make sure it complies with the regulations to be a Will in Alabama, that is: signed by the Testator/Testatrix (the one making a Will) and two witnesses in the presence of a Notary Public who certifies the signatures.

We have reviewed several of those documents. Most are four or five pages. It does qualify as a Will. However, a Will prepared by Estate Planning attorneys are 20 – 30 pages and cover contingencies such as children/beneficiaries predeceasing you, becoming incompetent prior to your death, being too young to manage money, having special needs requiring a supplemental needs trust and language to allow proper management of tax-sheltered accounts. All of which cannot be covered in five pages.

Trusts & Wills can be complex documents with tax implications, distribution issues, specific distribution rules, contingent beneficiary clauses, no contest provisions and other particular provisions. These documents are not forms that can just have names added in the blanks nor should they be.
